Terms of Service

The ground rules for using chckd. Written in plain language.

1. Acceptance of terms

By creating an account, accessing, or using chckd, you agree to these Terms of Service. If you're using chckd on behalf of a company or organization, you represent that you have the authority to bind that entity to these terms.

2. Description of service

chckd is a platform for building digital checklists, capturing inspection data on mobile devices, and generating branded PDF reports. It includes template management, submission tracking, team collaboration, analytics dashboards, and report delivery.

chckd is not a legal compliance tool, safety certification platform, or substitute for professional judgment. You are responsible for ensuring your use of chckd meets applicable regulatory requirements in your jurisdiction.

3. Account registration

  • You must provide accurate, complete information when creating an account.
  • You are responsible for maintaining the security of your password and account.
  • You must be at least 16 years old to create an account.
  • One person or entity may not maintain multiple free accounts.
  • You must notify us immediately of any unauthorized use of your account.

4. Your content

You own everything you create in chckd — templates, submissions, photos, signatures, reports, and all other content. We claim no ownership over your content.

By using chckd, you grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the service to you. This license terminates when you delete your account.

You are responsible for the content you create and share through chckd. You represent that you have all necessary rights to the content you upload.

5. Acceptable use

You agree not to:

  • Use chckd for any unlawful purpose or in violation of any applicable laws.
  • Attempt to access other users' accounts, data, or systems.
  • Interfere with, disrupt, or overload the service or its infrastructure.
  • Use automated tools (bots, scrapers, crawlers) to access or interact with the service, except through our official API.
  • Upload malware, viruses, or any content designed to harm the service or its users.
  • Resell, redistribute, or sublicense chckd without written permission.
  • Circumvent usage limits, authentication, or authorization controls.
  • Impersonate another person or entity.

6. Subscriptions and payments

  • Free tier. Limited to 1 checklist template and 10 reports per month. Subject to change with notice.
  • Paid plans. Billed monthly in advance. Prices displayed in your selected currency; checkout processed in KES via Paystack.
  • Renewal. Subscriptions auto-renew at the end of each billing period unless cancelled.
  • Cancellation. Cancel anytime from the billing page. Cancellation takes effect at the end of the current billing period. No partial refunds for unused time.
  • Refunds. Refund requests are handled on a case-by-case basis within 14 days of payment. Contact support with your reason.
  • Price changes. We'll give 30 days' notice before any price increase. Existing subscribers keep their current rate for the current billing period.

7. PDF reports

chckd generates PDF reports based on data you enter. We do not guarantee that reports meet any specific regulatory, legal, or industry standard. You are solely responsible for verifying that your reports comply with applicable standards in your jurisdiction.

Reports are generated automatically and delivered as-is. We are not liable for errors in reports resulting from incorrect data entry.

8. Intellectual property

The chckd software, design, branding, and documentation are owned by CodeSmith Systems Ltd. and protected by copyright, trademark, and other intellectual property laws. These terms do not grant you any rights to use our trademarks, logos, or brand elements.

9. Service availability

We target 99.9% uptime but do not guarantee it. We may perform scheduled maintenance with advance notice. We are not liable for downtime, data loss, or service interruptions. Our total liability is limited as described in Section 12.

10. Data portability

You can export all your data at any time from the dashboard. Supported formats include CSV, JSON, and PDF. We do not lock in your data — it's yours and you can leave anytime.

11. Termination

By you. Delete your account at any time from settings. Your data is permanently removed within 30 days.

By us. We may suspend or terminate your account if you violate these terms, engage in abusive behavior, or if required by law. We will provide notice and an opportunity to remedy the violation where reasonable.

Effect. Upon termination, your right to use chckd ceases immediately. We will provide a 30-day window to export your data.

12. Limitation of liability

To the maximum extent permitted by law, chckd and CodeSmith Systems Ltd. are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability to you for any claim is limited to the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless CodeSmith Systems Ltd. and its officers, directors, and employees from any claims, losses, or damages arising from your use of chckd or violation of these terms.

14. Governing law

These terms are governed by the laws of Kenya. Any disputes will be resolved in the courts of Nairobi, Kenya.

15. Changes to these terms

We may update these terms from time to time. Material changes will be communicated via email or in-app notice at least 30 days before they take effect. Continued use after changes take effect constitutes acceptance.
